Welcome to OnePool! These terms and conditions establish the rules for using our platform, OnePool.
1. General Information
This document sets out the Terms and Conditions (“Terms”) governing access to and use of the website, services, and applications offered by OnePool Payments S.L., with registered office at Av. Botánico Cavanilles, 20, 46010 Valencia (Spain), and tax ID (NIF) B22996607 (“OnePool”, “we”, “our”).
By accessing and using the Services, you (“User”, “you”) accept these Terms in full, together with our Privacy Policy and any supplementary policies. If you do not agree with these Terms, please do not use the Services.
2. Scope of the Service
1. OnePool provides payment solutions that enable the creation and management of group payments (“Pools”), where several participants can contribute individually through their preferred payment methods.
2. Services include:
• Creating and managing group payments.
• Checkout integrations for merchants.
• Secure processing of payments through authorized payment service providers (“PSPs”).
• Automatic confirmation of bookings or purchases once the Pool is complete.
3. OnePool acts as a technological intermediary between merchants and contributors. OnePool does not issue electronic money nor directly hold customer funds outside the scope of its PSP partners.
3. Registration and Account Use
1. To access certain Services, you may need to create an account.
2. You agree to provide accurate, complete, and up-to-date information during registration.
3. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
4. OnePool reserves the right to suspend or terminate accounts in cases of misuse, fraud, violation of these Terms, or when required by law.
4. Implementation and Access
1. Merchants integrating OnePool into their checkout must follow OnePool’s technical documentation and guidelines.
2. OnePool may modify, suspend, or remove functionalities for technical, legal, or security reasons.
3. Access may be temporarily interrupted due to maintenance, updates, or system improvements.
5. Authorizations and Transactions
1. By using the Services, you authorize OnePool and its PSP partners to process individual payments and consolidate them according to Pool rules.
2. You guarantee that you are the legitimate holder of the payment methods used and are legally entitled to use them.
3. PSPs may apply security verifications, including Strong Customer Authentication (SCA) under PSD2 or other applicable regulations.
6. Payment Processing
1. Payments are processed through third-party PSPs (e.g., Stripe, Adyen, or other licensed providers).
2. OnePool does not store full card details.
3. Transaction confirmation is subject to PSP authorization and the effective receipt of funds.
4. Merchants will only receive confirmation once all Pool participants have successfully contributed.
7. Fees and Charges
1. OnePool may charge service fees, transaction commissions, or other applicable costs, which will be communicated to merchants prior to application.
2. Fees may be automatically deducted from processed transactions.
8. Refunds and Cancellations
1. Once a Pool is completed and the transaction confirmed, it cannot be cancelled, except in cases required by law or where expressly authorized by the merchant.
2. Refunds, when applicable, will be processed to each contributor through the same payment method originally used, in coordination with the PSP.
3. Refund timelines may vary depending on the issuing bank or PSP.
9. User Obligations
You agree to:
• Not use the Services for fraudulent, illegal, or rights-infringing activities.
• Not manipulate, interfere with, or attempt to gain unauthorized access to restricted areas of the system.
• Comply with all applicable regulations in relation to payments, data protection, and consumer rights.
10. OnePool’s Rights
OnePool reserves the right to:
• Reject or block suspicious transactions.
• Suspend or permanently terminate accounts that violate these Terms.
• Conduct technical audits of merchant checkout integrations.
11. Liability
1. OnePool shall not be liable for:
• Failures attributable to PSPs, banks, or third parties.
• Indirect damages, loss of profits, or loss of data.
• Delays in payment processing outside of its control.
2. OnePool’s maximum liability is limited to the total amount of service fees collected for the transaction giving rise to the claim, except in cases of fraud or gross negligence.
12. Intellectual Property
1. All content on the website, documentation, software, trademarks, and logos are owned by OnePool or licensed third parties.
2. You may not copy, distribute, reproduce, or commercially exploit such content without prior written authorization.
13. Data Protection
1. Personal data will be processed in accordance with the OnePool Privacy Policy.
2. Users may exercise their rights of access, rectification, deletion, opposition, portability, and restriction by contacting [legal@onepool.com].
14. Confidentiality
1. Both OnePool and Users agree to keep confidential all technical, financial, or commercial information accessed during the contractual relationship.
2. This obligation shall survive the termination of the relationship.
15. Amendments to the Terms
OnePool may update these Terms at any time. Updates will be published on the website and become effective upon publication. Continued use of the Services after updates implies acceptance of the new Terms.
16. Governing Law and Jurisdiction
1. These Terms are governed by Spanish law.
2. For any disputes arising from these Terms, the parties submit to the exclusive jurisdiction of the courts of Valencia, Spain, unless mandatory consumer protection rules provide otherwise.
